Terms of Service for Driveree App

Welcome to the Driveree App (the “App”). These Terms of Service (“Terms”) govern your access to and use of the App and the services provided by Driveree Online Delivery Pty Ltd (“Driveree,” “we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.
To use Driveree services, you must register and maintain an active personal user account (“Account”). Failure to maintain accurate, complete, and up-to-date information, including a valid payment method, may prevent access to or use of Driveree services.
The Driveree services are only available to persons 16 years or older. You may permit minors to receive deliveries if you take full responsibility for their actions. Compliance with all applicable laws and ensuring that delivery locations are accessible and safe is your responsibility. You may be asked to verify your identity to access or accept deliveries. Refusal to do so may limit access to services.
Driveree may create promotional codes (“Promo Codes”) that offer discounts or other benefits. By using Promo Codes, you agree that:
Driveree reserves the right to withhold benefits obtained through Promo Codes if deemed fraudulent, illegal, or in violation of applicable terms.
Driveree Charges:
Using Driveree services may result in charges (“Driveree Charges”) for services you receive. Charges for items purchased from merchants (“Merchant Charges”) are payable per Driveree and merchant terms.
General Payment Terms:
You agree to pay applicable Driveree Charges, which are in Australian Dollars and include GST and other applicable taxes. All payments are due immediately upon receiving services and processed using your designated payment method. If your primary payment method is invalid, Driveree may use any secondary method on file. Driveree may adjust charges with notice.
Gratuities:
Providing gratuities to delivery personnel is optional and does not impact service charges.
Cancellations and Refunds:
Order cancellation may incur charges if done after a specified time. If cancelled after delivery has begun, the full-service charge applies. If delivery fails or is cancelled due to your actions, charges for items and services will apply. Refunds may be granted if the failure is determined to be outside your control.
Limitation Subject to Local Consumer Law:
These limitations do not reduce consumer rights under applicable laws.
Disclaimer:
Except as required by Australian law, the services are provided “as is” and “as available.” Driveree disclaims all implied warranties, including fitness for a particular purpose. Your use of the services is at your own risk.
Liability
Driveree Online Delivery Pty Ltd maintains a structured process to handle complaints, managed reasonably in compliance with Australian Consumer Law.
You agree to indemnify Driveree Online Delivery Pty Ltd, its affiliates, officers, and employees against claims, liabilities, or expenses (including legal fees) arising from:
If Driveree Online Delivery Pty Ltd contributed to the losses, your liability is reduced proportionately.
These Terms are governed by the laws of New South Wales, Australia. Disputes may be resolved through complaints, arbitration, or New South Wales courts. Proceedings, documents, and related communications remain confidential unless disclosure is necessary and agreed upon.
